These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Talkif ("Company," "we," "us," or "our") governing your access to and use of our AI voice agent platform and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law
• Provide accurate and complete registration information

Talkif provides an AI-powered voice agent platform that enables you to:

• Create and configure AI voice agents for automated phone calls
• Initiate outbound calls and receive inbound calls through AI agents
• Manage contacts and call records
• Access call recordings, transcripts, and analytics
• Design conversation flows using our visual builder
• Integrate with third-party services via APIs

4.1 Prohibited Activities

You agree NOT to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Make calls without proper consent where required by law
• Engage in telemarketing spam, robocalling, or other unsolicited communications
• Harass, threaten, defame, or defraud any person or entity
• Impersonate any person or entity
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems

4.2 Telecommunications Compliance

You are solely responsible for ensuring compliance with all applicable telecommunications laws, including TCPA, TSR, Do-Not-Call Registry requirements, and GDPR.

• All fees are charged in advance on a subscription basis or based on usage
• You authorize us to charge your payment method for all applicable fees
• All fees are non-refundable except as expressly stated
• Failed payments may result in suspension of your account

The Service, including all software, technology, designs, trademarks, and content (excluding User Content), is owned by Talkif and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying any AI-generated outputs before relying on them.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any claims arising from your violation of telecommunications laws

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States. Any dispute shall be resolved through binding arbitration administered by the American Arbitration Association.
